Terms of use.

These Terms of Use ("Terms") are a legal agreement between you and Equil AI ("Equil", "we", "us", or "our"), a solo developer based in Bulgaria (European Union), regarding your use of the Equil AI mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

01THE APP

Equil is a personal nutrition and fitness coaching app. It provides food logging, AI-assisted nutrition estimates, adaptive macro targets, training and recovery guidance, hydration forecasts, and related features. The App is a tool to support your own decisions — see the health disclaimer in Section 7.

02ELIGIBILITY

You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement and that the information you provide is accurate.

03YOUR ACCOUNT

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date. You may delete your account at any time from within the App.

04SUBSCRIPTIONS, FREE TRIAL & BILLING

The App offers premium features through an auto-renewable subscription, available on a monthly or yearly basis. A 3-day free trial may be offered to new subscribers.

• Payment is charged to your Apple ID account at confirmation of purchase (after any free trial).
• Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price for the plan you selected.
• You can manage or cancel your subscription at any time in your App Store account settings. Canceling stops future renewals; it does not refund the current period.
• If you do not cancel a free trial at least 24 hours before it ends, it converts to a paid subscription automatically. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Prices may change; we will give notice of price changes as required, and continued use after a change takes effect constitutes acceptance.

All purchases are processed by Apple through the App Store and are subject to Apple's terms. Refunds are handled by Apple in accordance with App Store policies; we generally cannot issue refunds directly.

05LICENSE

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, reverse engineer, or attempt to extract the source code of the App, except to the extent permitted by law.

06ACCEPTABLE USE

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to disrupt, damage, or gain unauthorized access to the App, our servers, or other users' data.
• Upload content that is illegal, harmful, or infringes others' rights.
• Use the App to develop a competing product, or scrape or harvest data from it.

07HEALTH DISCLAIMER (IMPORTANT)

Equil provides general fitness, nutrition, and wellness information for informational and educational purposes only. It is NOT medical advice, diagnosis, or treatment, and it is not a substitute for the advice of a qualified physician, dietitian, or other healthcare professional.

• Always consult a qualified professional before starting any diet, exercise, supplement, or wellness program, especially if you have a medical condition, are pregnant, or take medication.
• Nutrition estimates (including AI food-scan results), recovery scores, and recommendations are approximations and may be inaccurate. Do not rely on them for medical decisions.
• The App does not detect, diagnose, treat, cure, or prevent any disease or medical condition, and is not a medical device.
• If you experience pain, dizziness, or any medical emergency, stop and seek professional help immediately.

You use the App and act on its guidance at your own risk.

08AI-GENERATED CONTENT

Some features use artificial intelligence (including Google's Gemini service) to analyze photos and generate estimates and recommendations. AI output can be incomplete, inaccurate, or unexpected. You are responsible for evaluating it before relying on it.

09INTELLECTUAL PROPERTY

The App, including its design, text, graphics, logos, and software, is owned by Equil and protected by intellectual-property laws. You retain ownership of the content you create or upload (such as your logs, programs, and photos), and you grant us a limited license to process that content solely to provide the App's features to you.

10THIRD-PARTY SERVICES

The App relies on third-party services (including Apple, Google, Supabase, RevenueCat, and Open Food Facts). Your use of those services may be subject to their own terms. We are not responsible for third-party services.

11DISCLAIMER OF WARRANTIES

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that results will meet your expectations.

12LIMITATION OF LIABILITY

To the maximum extent permitted by law, Equil shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or health outcomes, arising from your use of (or inability to use) the App. Our total liability for any claim relating to the App shall not exceed the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13TERMINATION

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including health disclaimer, IP, disclaimers, and limitation of liability) will survive.

14GOVERNING LAW

These Terms are governed by the laws of Bulgaria, without regard to its conflict-of-laws rules, and (where applicable) by mandatory consumer-protection laws of your country of residence in the EU.

15CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will revise the "Last updated" date, and where appropriate notify you in the App. Continued use of the App after changes take effect means you accept the updated Terms.
